Principles for delineating and distributing powers between levels of public authority: Verkhovna Rada adopts draft law as a basis

On 7 April, the Verkhovna Rada adopted the Government’s Draft Law on the Principles of Delineation and Distribution of Powers between Levels of Public Authority (Reg. No. 14412) as a basis.

The Draft Law aims to establish the legal framework for the delineation and distribution of powers among local governments of different levels, and among executive authorities, based on the principles of subsidiarity and decentralisation.

The provisions of the Draft Law propose, in particular, to define:

  • the basic principles of the delineation and distribution of powers between levels of public authorities;
  • the levels of public authority (state, regional, and local) and the entities between which powers are distributed;
  • the criteria for assigning powers to the relevant level of government;
  • the procedure for delegating state powers to local governments;
  • the mechanisms for coordination and interaction between different levels of authority;
  • the requirements for financial, human resources, and information support for the exercise of powers.

The document is an important indicator of the implementation of the Ukraine Plan, approved with a view to implementing the EU’s Ukraine Facility tool, the measures set out in the Roadmap on the Reform of Public Administration, and the European Commission’s recommendations presented in the Report on Ukraine’s Progress within the framework of the 2025 European Union enlargement package.

Responsible for developing Draft Law No. 14412 is the Committee on the Organisation of State Power, Local Self-Government, Regional Development and Urban Planning.
